Copyright & Takedown Policy

This Copyright & Takedown Policy explains how MyLittleWorld Inc. ("MyLittleWorld," "we") respects intellectual property rights, what MyLittleWorld expects of Users regarding content they upload to the platform, and the process for reporting and resolving claims of copyright infringement. This Policy applies to all content uploaded to the MyLittleWorld platform, including organization logos and branding assets, photographs, daily-report and incident-report images, and documents.

1. Purpose and Scope

This Policy sets out MyLittleWorld's approach to copyright and takedown requests, as summarized above.

2. Your Responsibility to Respect Third-Party Rights

You may only upload content to the Service that you own outright or that you have obtained the legal right to use for this purpose. This includes your organization's own logo and branding materials, photographs you or your organization's staff have taken (or for which you have obtained appropriate permission or licensing, including parental consent where a child is depicted), and documents you are authorized to store and share, such as forms, policies, or licensed templates. Uploading content that belongs to a third party — including stock images used outside the terms of their license, another organization's branding, or documents authored by someone else — without the necessary rights is a violation of both this Policy and MyLittleWorld's Acceptable Use Policy, and may expose you and your organization to legal liability independent of any action MyLittleWorld takes.

3. Ownership of Your Content

As between you and MyLittleWorld, you retain ownership of the content you upload to the Service. MyLittleWorld does not claim ownership over your logos, photographs, or documents. By uploading content, you grant MyLittleWorld a limited license to host, store, reproduce, and display that content solely as necessary to operate and provide the Service to you and your authorized Users (for example, displaying a child's daily-report photo to that child's parent). The full scope of this license, along with related terms governing data retention and deletion, is set out in MyLittleWorld's Terms of Service, which this Policy does not attempt to restate in full.

4. Notice-and-Takedown / Notice-and-Notice: How MyLittleWorld Handles Infringement Claims

MyLittleWorld is a Canadian company and, in appropriate cases, also has connections to United States infrastructure and users (including through third-party hosting providers such as Vercel). Because of this, MyLittleWorld operates a hybrid process intended to meet both Canadian and United States expectations for handling claims of copyright infringement.

4.1 Canadian Notice-and-Notice Process. Under Canada's Copyright Act, internet intermediaries such as MyLittleWorld are generally required to forward a valid notice of claimed infringement to the User alleged to have posted the infringing material, and to retain records that may identify that User for a period specified by law, rather than being required to remove content automatically. Where a claim is submitted under this framework, MyLittleWorld will, upon receiving a valid notice, forward it to the User who uploaded the material in question and preserve relevant records as required by Canadian law. MyLittleWorld encourages, but does not always require, additional voluntary removal or disabling of access where the claim appears well-founded and the content is not otherwise defensible.

4.2 DMCA-Style Takedown Process. Independent of the notice-and-notice process, MyLittleWorld also maintains a takedown process modeled on the U.S. Digital Millennium Copyright Act ("DMCA") for claims connected to U.S.-based infrastructure or users, or where a rights holder specifically requests removal under this framework. Upon receiving a valid takedown notice meeting the requirements below, MyLittleWorld will remove or disable access to the identified material.

4.3 What a Valid Notice Must Include. Whether submitted under the notice-and-notice framework or as a DMCA-style takedown request, a valid infringement notice sent to copyright@mylittleworld.ca must include:

  • identification of the copyrighted work you claim has been infringed, with enough detail for MyLittleWorld to locate and identify it;
  • identification of the material you claim is infringing, including its location on the Service (such as a URL, organization name, or other identifying detail sufficient for MyLittleWorld to locate it);
  • your name, mailing address, telephone number, and email address, or that of the person authorized to act on behalf of the rights holder;
  • a statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law; and
  • a statement, made under penalty of perjury (for DMCA-style requests) or otherwise attesting to accuracy under applicable Canadian law, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf, along with your physical or electronic signature.

Notices that omit required elements may not be actionable and MyLittleWorld may request clarification or additional information before proceeding.

5. MyLittleWorld's Response

Upon receiving a complete and valid notice, MyLittleWorld will review the claim and, where appropriate, remove or disable access to the identified material. MyLittleWorld will notify the User who uploaded the material that a claim was received and, consistent with Canada's notice-and-notice requirements, will forward the substance of the notice to that User. MyLittleWorld aims to act on complete notices promptly, though response time may vary depending on the complexity of the claim.

6. Counter-Notice Process

If you believe content you uploaded was removed or disabled in error — for example, because you own the rights to it, have a license to use it, or your use qualifies as fair dealing or fair use — you may submit a counter-notice to copyright@mylittleworld.ca. A valid counter-notice must include:

  • identification of the material that was removed or disabled and its location on the Service prior to removal;
  • a statement, under penalty of perjury or otherwise attesting to accuracy under applicable law, that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification;
  • your name, address, telephone number, and email address, and a statement consenting to the jurisdiction of the applicable courts; and
  • your physical or electronic signature.

Upon receiving a valid counter-notice, MyLittleWorld will forward it to the original complainant. Depending on the framework under which the original notice was submitted and applicable law, MyLittleWorld may restore the content after a reasonable waiting period unless the original complainant provides notice that they have initiated a legal action to restrain the User from engaging in the allegedly infringing activity. MyLittleWorld reserves discretion to make final determinations in ambiguous cases, including where children's safety or privacy considerations under this Policy or the Acceptable Use Policy intersect with a copyright claim.

7. Repeat Infringer Policy

MyLittleWorld will terminate, in appropriate circumstances, the accounts of Users who are determined to be repeat infringers of third-party copyright. MyLittleWorld tracks valid infringement notices received against a given account and, where a pattern of repeated infringement is established, may suspend or permanently terminate the account and associated organization access, independent of any other enforcement action under the Acceptable Use Policy.

8. Misrepresentations

Submitting a knowingly false or materially misleading infringement notice or counter-notice may result in legal liability for the person submitting it, including liability for damages. MyLittleWorld reserves the right to disregard notices or counter-notices it reasonably believes to be abusive, fraudulent, or submitted in bad faith.

10. Changes to This Policy

MyLittleWorld may update this Policy from time to time. Material changes will be communicated to organization administrators. Continued use of the Service after changes take effect constitutes acceptance of the updated Policy.
